On August 18, 2021, the amending draft of the Environmental Noise Pollution Prevention and Control Law was deliberated by the National People's Congress.
New draft of the law is more detailed with the clarification on noise, legal responsibilities, and penalties on violation.
According to the 2021 China Environmental Noise Pollution Prevention and Control Report issued by the Ministry of Ecology and Environment, the Ministry of Ecology and Environment have received a total of more than 441,000 complaints about environmental pollution from the public in 2020, of which noise disturbances took up 41.2%, ranking second among all pollution complaints. It is second only to air pollution. And more than half of the noise complaints were about social life noises, the loud music of square dance was mentioned a lot as a significant problem.
In order to standardize and guide the prevention and control of environmental noise pollution, a total of 293 nationwide and local regulations were made in 2020 alone. Some cities have even issued special regulations to prevent loud noise from square dance.
It is understood that the current Environmental Noise Pollution Prevention and Control Law came into effect on March 1, 1997, and individual provisions were amended in 2018. Over the past 20 years, the noise pollution prevention and control situation has undergone major changes in China, and the law can no longer meet the requirements of the new situation and urgently need to be revised and improved.
The draft strengthens noise classification and focuses on outstanding issues. Regarding the noise of social life, activities such as entertainment and fitness could only be carried out in public places at designated time and areas.
According to the draft, if someone organizes or joins entertainment, fitness and other activities in public places such as streets, squares, parks, etc., any failure to comply with the regulations on activity areas and time periods will be considered as violation of the law.
If the loud noise disturbs people living around, and the related personnel refused to correct the behaviors, then the related personnel will be fined for two hundred to five hundred Yuan.
